Our Terms & Conditions :

 

 

Hirer shall provide REAL SOUNDZ with safe and appropriate working conditions. This includes, but is not limited to, providing an area 3.75 meters by 2.5 meters for the DJ’s main setup for setting up speakers and lighting stands, 2x 240-volt outlets from a reliable power source within 3 meters (along the wall) of the set-up area. It is understood that if this is a "Rain or Shine" event, REAL SOUNDZ performance fee is in no way affected by inclement weather. For outdoor performances, Hirer shall provide overhead shelter for setup area. The REAL SOUNDZ reserves the right, in good faith, to stop or cancel the performance should the weather pose a potential danger to the equipment, or audience. Every effort will be made to continue the performance. However, safety is paramount in all decisions. The performance fee will not be affected by such cancellation. Where REAL SOUNDZ is engaged to work alongside a band (or other entertainer), it is the Hirer’s responsibility to ensure that adequate space exists within the venue for both entertainers to set up their equipment and that separate power outlets exist. The Hirer will inform REAL SOUNDZ prior to performance date confirmation of venue sound limiter installation. Please note: REAL SOUNDZ  reserves the right to decline entertainment at venues with a sound limiter installed.

 

10).     A written event/music planner or music request list must be received by THE HIRER prior to the event for it to be included in REAL SOUNDZ  event schedule. With or without the aid of an event/music planner or music request list, REAL SOUNDZ shall attempt to play Hirer and Hirer’s guest’s music requests but shall not be held responsible if certain selections are unavailable. REAL SOUNDZ will make an extra effort to have music requests available if they are received by REAL SOUNDZ”IN WRITING" at least two weeks prior to the event.

 

 

11).     The Hirer agrees to provide adequate supervision of guests and will ensure that venue management adequately supervises customers and or staff on site premises. Please note: Where the function may include guests under the age of 16 years, the Hirer (or parent) is responsible for the behaviour and safety of any minors attending the venue. The Hirer will provide and maintain adequate adult supervision at all times. REAL SOUNDZ will not be liable for the supervision of minors.

 

12).    Hirer will take steps to protect REAL SOUNDZ  equipment, music and personnel during the contracted period. Any damages incurred due to a lack of reasonable protection on your part (except in the case of gross negligence on the part of  REAL SOUNDZ will be payable by Hirer to the extent of repair or replacement of damaged music and/or equipment, and all costs of medical treatment. 

 

13).    In the event of circumstances deemed by REAL SOUNDZ to present a threat or implied threat of injury or harm to REAL SOUNDZ  staff or any equipment in REAL SOUNDZ possession, REAL SOUNDZ reserve the right to cease performance with the full balance still payable. If the Hirer is able to resolve the threatening situation in a reasonable amount of time (maximum of 15 minutes), REAL SOUNDZ  shall resume performance in accordance with the original terms of this agreement, However any time lost will not be added to the end of the agreed performance time. In order to prevent equipment damage or liability arising from accidental injury to any individual attending this performance, REAL SOUNDZ reserves the right to deny any guest access to the sound system, music recordings, or other equipment.

 

14).     This agreement cannot be cancelled except by mutual written consent of both the Hirer and REAL SOUNDZ . If cancellation is initiated by the Hirer in writing and agreed to by REAL SOUNDZ  in writing, Hirer will be required to pay (in addition to the reservation fee) 50% of the balance is payable if the event is cancelled within 28 days or the full balance if cancelled within 7 days and any unrecoverable costs already incurred by REAL SOUNDZ. (but not more than the total fee agreed upon). Please note the reservation fee is non refundable under any circamstances.  

 

15).     This agreement of  REAL SOUNDZ  to perform shall be excused by detention of personnel by sickness, accidents, riots, strikes, epidemics, Pandemics, acts of God, Force of nature  or any other legitimate condition beyond REAL SOUNDZ  control. If such circumstances arise, all reasonable efforts will be made by REAL SOUNDZ  to find a replacement entertainment at the agreed upon fees. Should REAL SOUNDZ be unable to procure a replacement, Hirer shall receive a full refund of all fees paid to REAL SOUNDZ . Hirer agrees that in all circumstances, REAL SOUNDZ  liability shall be exclusively limited to refunding the fees paid and that REAL SOUNDZ  shall not be liable for indirect or consequential damages arising from any breach of contract.Please note the Reservation fee is non refundable under any circumstances.

 

16).     Hirer is responsible for paying any charges imposed by the venue. These charges may include, but are not limited to, use of electric power, fire marshall (for use of fog), overtime before and after the engagement utilized by REAL SOUNDZ  for setting up and taking down equipment. 

 

17).     This agreement shall be governed by the laws of England. In the event of suit involving or relating to this agreement, Hirer agrees that venue will be in a medway County Court. In the event of non-payment, REAL SOUNDZ  retains the right to attempt collection through the medway County courts. Hirer will be held responsible for all court fees, legal fees, and collection costs incurred by REAL SOUNDZ . Hirer shall be charged £10 for each bounced transfer  plus a £5 service charge for each collection notice.
